Terms and Conditions
1. Introduction These Terms and Conditions govern the use of our website and services. By engaging with our company, you agree to comply with and be bound by these Terms and Conditions.
2. Payment Terms
- A non-refundable deposit of 50% of the total project fee is required before work commences.
- The remaining 50% is due upon completion of the project and before the final delivery of the website or related services.
- Work will only begin once all mandatory information outlined in the client intake form or contract has been submitted.
3. Project Commencement and Client Delays
- Work will commence only once the client has provided all required information as specified in the contract.
- Any delays from the client in providing necessary information will result in a corresponding delay in project delivery.
- If the client is uncontactable or delays the project for two weeks without compliance, our company reserves the right to refuse or decline to commence or continue the work. A non-refundable penalty will be imposed, and the termination of the contract will be binding as stated in the contract.
4. Non-Payment and Legal Action
- Non-payment of the final 50% balance upon completion will result in legal action.
- We reserve the right to withhold the delivery or release of any work completed until full payment is received.
- Non-payment will also result in the suspension of services, and a penalty fee of 30% on top of the outstanding service amount will be imposed.
5. Limitation of Liability
- Our company shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the website or services provided.
- The client assumes all responsibility for the use and performance of the delivered work once completed and paid for in full.
6. Intellectual Property
- All intellectual property rights for the completed work will remain with the company until full payment has been received.
- Upon full payment, the client will be granted the necessary rights to use the delivered work as outlined in the contract.
7. Termination and Refunds
- The initial deposit is non-refundable under any circumstances.
- If the contract is terminated due to client non-compliance or delays exceeding two weeks, the client forfeits all amounts paid, and the contract will be considered void.
8. Amendments
- We reserve the right to update and modify these Terms and Conditions at any time. It is the client’s responsibility to review these Terms regularly.
9. Governing Law These Terms and Conditions are governed by and construed in accordance with the laws of South Africa.
10. Acceptance of Terms By engaging with our company and submitting the required deposit, the client acknowledges and agrees to these Terms and Conditions.
